Joe Biden’s vice presidential nominee, Sen. Kamala Harris (D-CA), continued to tow the party-line “non-talking points” as she once again refused to directly answer whether or not she and Joe Biden would pack the US Supreme Court is elected.
Harris deliberately dodged a pair of direct questions from Vice President Mike Pence during the vice presidential debate Wednesday night on the subject. Democrats across the board have floated the possibility of packing the High Court in retaliation for confirming and seating Judge Amy Coney Barrett, President Trump’s nominee before Inauguration Day.
“When you speak about the Supreme Court though, I think the American people really deserve an answer, Senator Harris,” Pence queried Harris. “Are you and Joe Biden going to pack the court if judge Amy Coney Barrett is confirmed?”
Harris responded obtusely by pointing to the year 1864, during which President Abraham Lincoln opted to not nominate a judge to the court before the election. Her response did not address the issue posed to her by the Vice President.

“The American people are voting right now. They’d like to know if you and Joe Biden are going to pack the Supreme Court if you don’t get your way in this nomination,” Mr. Pence responded. “The American people deserve a straight answer and if you haven’t figured it out yet,” the Vice President said in directing his comments to the audience, “the straight answer is that they are going to pack the Supreme Court.”
Before the moderator could regain control of the direction of the debate, Harris accused the Trump administration of appointing ideologues and racists to lifetime positions on the circuit courts.
Neither former Vice President Biden nor Sen. Harris has provided a straight answer on whether or not they would move to expand the High Court if elected.
