House and Senate Democrats are planning a new bill to pack the Supreme Court.
According to a report by The Intercept, Congressional Democrats will unveil the new legislation on Thursday.
“The bill would add four seats to the high court, bringing the total to 13, from the current 9. The number of justices on the Court has fluctuated widely throughout the course of the nation’s history. Republicans currently hold 6 seats, while Democrats hold just 3 after the death of Justice Ruth Bader Ginsberg and the quick confirmation of Justice Amy Coney Barrett.” The Intercept reported.
House Judiciary Chairman Jerry Nadler, Subcommittee chair Hank Johnson, and Rep. Mondaire Jones are leading the charge in the House and it’s being backed by Ed Markey (MA) in the Senate.
Last Friday Joe Biden announced an executive order to look into packing the US Supreme Court.
The Executive Order on the Establishment of the Presidential Commission on the Supreme Court of the United States is accessible via The White House webpage. This Executive Order creates a Commission, composed of not more than 36 members all appointed by the President, to provide an analysis on Supreme Court reform including court-packing, judicial term limits and other proposals. The functions of this Commission are as stated:
To provide “An account of the contemporary commentary and debate about the role and operation of the Supreme Court in our constitutional system and about the functioning of the constitutional process by which the President nominates and, by and with the advice and consent of the Senate, appoints Justices to the Supreme Court;”. What does this mean? In layman’s terms, this Commission will put forth progressive ideas aimed at changing the way Supreme Court operates and how Justices are appointed. The Commission will also provide “An analysis of the principal arguments in the contemporary public debate for and against Supreme Court reform, including an appraisal of the merits and legality of particular reform proposals.”
Joe Biden repeatedly dodged the question about court packing during the 2020 election.
Court packing is not supported by the majority of the American people but the Democrats are moving full steam ahead anyway.
Update: Rep. Jim Jordan (R-OH) asked Jerrold Nadler if The Intercept’s report is true about his plans to pack the court and Nadler wouldn’t answer.
